£55,000 for foot injury in factory
Ms H suffered a significant foot injury when when she tripped on a hose pipe which was stretched across the factory floor. Her employer would routinely hose down the factory whilst workers were working, resulting in hosepipes posing a tripping hazard for workers.
Whilst she did not fall to the floor, she landed awkwardly on her foot when she tripped, resulting in fracture injuries to her foot. Understandably, as well as substantial foot pain, Ms H also developed psychological injury in the form of anxiety.
A friend recommended Aston Knight Solicitors and we were pleased to accept her case on a full no-win no-fee basis.
We quickly obtained a full admission of liability from the factory’s insurance company and then obtained specialist expert evidence from both a foot and ankle surgeon and a psychologist.
The foot and ankle surgeon identified an instability in Ms H’s foot and recommended she wear insoles from now on. The psychological expert identified an anxiety disorder and recommended treatment.
Following negotiations an excellent settlement of £55,000 was secured.
Ms H was delighted with the outcome and commented:
“…it is still more than I generally expected… …and I want to say a big thank you for your help”
James Winterbottom, solicitor, comments:
“Sadly, despite strict health and safety laws for workplaces, including factories, for many years, we continue to see many factory injury at work cases. Following the accident the factory changed their system of work to avoid similar injuries but such changes could easily have been made beforehand.
The vast majority of work injuries can be prevented with proper planning and risk assessments. A competent risk assessment would have identified the risk of a tripping injury and therefore designed an alternative method, which the company did following the accident.”
Managing Director, Ayoub Khan, adds:
“This case not only exemplifies Aston Knight Solicitors’ proficiency in work injury cases, being a core specialism of the Firm, but also the importance of engaging a specialist personal injury solicitor. Whereas many personal injury firms instruct general orthopaedic experts who produce basic reports, in this instance we obtained a report from a specialist foot and ankle surgeon who was able to identify issues such as the foot instability, which increased the settlement value.”
Aston Knight Solicitors are a Chambers UK and Legal 500 recommended firm specialising in personal injury and clinical negligence. We act on a no-win no-fee basis and are always pleased to have a no-obligation confidential discussion.
