£25,000 recovered for injured shopper
Mr D was injured when manoeuvring a trolley loaded with goods. All trolleys at the Defendant’s stores, by design, have to be pulled and so as Mr D exited the store he pulled the trolley behind him. The ramp outside the main exit was only approximately 1 meter in length, with bollards at the end and therefore the turning area following exiting the store was very small. As Mr D tried to turn the trolley, the momentum of the trolley, owning to the fact it was on the ramp, caused it to roll down the ramp and crush Mr D’s hand between the trolley and the bollard.
A claim was brought against the Defendant, a national homeware store, and liability was initially denied. The Defendant provided a video reconstruction of an actor re-enacting the accident. Aston Knight Solicitors carefully consider this evidence and quickly pointed out that the trolley used was a newer trolley and not the same design as used by Mr D. At the same time Aston Knight Solicitors obtained their own supportive evidence in the form of photographs showing the bollards had now been cut down with some protection placed on top of the bollards to avoid injury being caused. Liability was later admitted and a settlement was reached in the sum of £25,000.
