£65,000 for local client who was injured at work
Mr K instructed Aston Knight Solicitors in relation to a workplace injury involving a circular saw. The saw was missing a guard and this led to the blade coming into contact with Mr K’s hand and causing a partial amputation of the middle finger.
Liability was denied by the Defendant throughout and they argued, amongst other things, that Mr K was the author of his own misfortune as he knew that the guard was missing.
Mr K had a turbulent personal life which the accident injuries contributed to. The Defendant sought to take advantage of the issues in Mr K’s personal life by arguing that these contributed to the occurrence of the accident in the first place and by arguing that Mr K’s future earning capacity would have been minimal regardless of his involvement in the accident.
Aston Knight adopted a sympathetic approach to Mr K and his situation and realised that his presentation was more likely a symptom of the serious injuries he had suffered rather than a cause.
We instructed a reputable orthopaedic hand surgeon as well as a plastic surgeon, following which we issued court proceedings against the Defendant.
Soon after issuing proceedings the Defendant made an offer of settlement and, following a period of extensive negotiations, a settlement was reached in the sum of £65,000.
In all the circumstances, this was an excellent outcome for Mr K.
