£70,000 for local client who dislocated his shoulder following a fall at work
Mr X was injured at work when he tripped on a collapsed ‘wet floor’ sign which was lying flat on the ground. Mr X dislocated his shoulder causing him to suffer a large ligament tear as well as a small fracture.
Upon Mr X instructing Aston Knight, it was obvious his immediate concern was his recovery over and above any compensation Aston Knight were able to recover for him. We immediately set about investigating the accident and obtained CCTV footage showing the fall. We submitted the claim to the workplace in question and secured an early admission of liability. This enabled us to engage the Rehabilitation Code with the Defendant insurers and arrange an assessment to identify and address Mr X’s rehabilitation needs. This resulted in Mr X receiving private physiotherapy treatment.
Safe in the knowledge Mr X’s rehabilitation needs were being met, Aston Knight proceeded to instruct a leading shoulder surgeon for a medical report addressing Mr X’s injuries and the impact on his daily living and employment. The shoulder expert ultimately concluded that it was reasonable for Mr X to take early retirement and so we were able to pursue a claim for future loss of earnings.
Following extensive negotiations, we were delighted to reach a settlement of £70,000, which exceeded Mr X’s expectations as he expressed in his feedback as follows:
