£6,000 recovered for a local client against Bury Council
Mrs B was shopping at ‘The Rock’ shopping centre in Bury town centre when she tripped on an uneven and loose flagstone and sustained an injury. Mrs B instructed Aston Knight Solicitors and within a few weeks we had carried out a site inspection and took detailed photographs of the defect in question.
We submitted the claim to Bury Council who initially denied liability on the basis that they had in place a reasonable system of inspection and maintenance.
The photographs taken by Aston Knight Solicitors went someway to disproving the Council’s assertion and, notwithstanding the advice of a Barrister that the claim did not have reasonable prospects, we carried on with the case.
Mrs B suffered a fractured shoulder as a result of this fall, and we obtained a report from a reputable shoulder surgeon which set out the details of the injury and the impact upon Mrs B.
We issued Court proceedings against Bury Council and they responded by confirming that liability was now admitted. With the issue of liability being resolved, settlement negotiations ensued and a settlement was reached in the sum of £6,000 (this figure reflecting the fact that Mr B had recovered from her injury within 10-12 weeks).
