£25,000 settlement following fall on wet steps at work
Ms Q worked in a chocolate making factory as a factory worker. Despite her employer being aware of a leaking roof for some time, no repairs were undertaken, resulting in water accumulating on a metal staircase below. One day Ms Q was carrying work equipment down the steps when she slipped on a puddle of water caused by the leaking roof above.
She slipped and fell backwards, banging her back and neck on the metal staircase.
A family member who had previously had a successful case with Aston Knight Solicitors recommended her to us and we were pleased to accept her case on a no-win no-fee basis.
Following securing a full admission of liability from the factory’s insurance company, we obtained medical reports from specialist expert witnesses in order to prove Ms Q’s injuries and value her case.
The medical evidence proved to be complex as Ms Q suffered a mixture of concussion, neck and back pain and also dizziness. We therefore obtained reports from a neurologist and spinal surgeon and by using that evidence were able to secure a strong settlement of £25,000, which Ms Q was delighted to receive.
James Winterbottom, solicitor, comments:
“Regrettably, this particular chocolate factory is a very frequent source of workplace injuries, despite being a large company. Our firm has pursued many successful injury at work claims against them over the years but workplace health and safety is yet to show any signs of improvement.
Complying with basic health and safety laws – in this case fixing a leaking roof which was creating slipping hazards for workers – would have avoided a nasty injury and this legal action. UK workplace health and safety laws require employers to provide employees with a safe place of work and to keep work equipment in good repair. If repairs cannot be undertaken immediately then the area should be made safe until it can such as dangerous areas being shut off and/or slipping hazards being remedied.”
Ayoub Khan, Managing Director, adds:
“Aston Knight Solicitors have accumulated a long and impressive track record in work injury matters, ranging from smaller claims to cases exceeding £1 million, which this case is a further example of.
Unlike the majority of personal injury firms at present, we ensure every case is closely overseen by a senior and proven specialist solicitor, which is a key factor in our recognition in both the prestigious Chambers UK and Legal 500 directories.
We offer a no-obligation confidential initial discussion and would be pleased to assist with any queries you may have.”
