Ian* attended the emergency department of his local hospital with ankle pain after suffering a fall. Despite an X-ray revealing a fracture he was advised that the X-ray was clear and discharged with the type of walking boot ordinarily utilised for simple soft tissue injuries as opposed to having his fracture fixed in place.

He continued to suffer ankle pain symptoms and so attended another emergency department of another hospital, being part of the same Trust, a few days later. Despite that second department having access to the previous X-rays which documented the fracture, he was again discharged without treatment.

He subsequently attended another hospital whereby the fracture was detected though by that time it was suspected that the failure to adequately treat the fracture previously had resulted in it beginning to heal in an incorrect position, as well as having caused Ian unnecessary pain and suffering in between.

Ian instructed Aston Knight Solicitors to investigate and after relevant records were obtained the expert opinion of an Emergency Department Consultant expert witness was sought who advised that Ian’s fracture should have been spotted and that he should have been admitted for treatment rather than being discharged with the walking boot.

Although the Defendant Trust denied liability, arguing that Ian’s treatment would have been the same even if the fracture had been correctly spotted, and although Ian sadly passed away due to unrelated reasons before further investigations could take place, a settlement of £1,200 was negotiated.

Ian’s sister, who became the client following Ian’s passing, commented:

“Two points emerge from this case. The first point is that a case need not necessarily end if a client passes away – the law entitles other people to take over conduct of a case in place of a deceased person. A second point here is that just because there are contrary views on liability this does not necessarily mean that a settlement cannot be reached as there will always be litigation risk on both sides. Many firms will close disputed cases for commercial reasons but often a compromise position can be reached thus recovering compensation for the client.”
