£1.5 million for road traffic accident victim with brain injury

Ms X was involved in a serious car accident in which she tragically suffered a significant head injury. The case was complicated by the fact the driver was uninsured and uncooperative with the case. Other vehicle occupants were also uncooperative and given that the client could not recollect the incident due to the nature of the head injury there was a lack of reliable evidence to establish what exactly happened, including whether she was wearing a seatbelt.

She approached Aston Knight Solicitors who accepted the case and began investigating. Due to the circumstances the matter was complicated and the defendant’s representatives took a difficult stance including alleging she was not wearing a seatbelt at the time and thereby sought to reduce her compensation on that basis. Following detailed investigations Aston Knight Solicitors managed to uncover sufficient evidence to prove what had happened including the fact that she was wearing a seatbelt at the time.

Expert evidence was obtained from various specialists including a neurologist, a neuropsychologist, a neuropsychiatrist, and a chronic pain expert. Furthermore, a senior brain injury specialist barrister was brought into the case to ensure the maximum possible result was secured for the client.

Although the defendant’s representatives continued to adopt a difficult stance including alleging that most of her problems were not caused by the brain injury but would have been there in any event, following sustained pressure negotiations ultimately resulted in a settlement in excess of £1.5 million which will ensure the client has the necessary support and financial security for the future.
