Recently I blogged about the value of personal injury claims; a point linked to this is one of ensuring you have a qualified, experienced solicitor acting for you.
 
Using the example from my earlier blog:

It might be you suffered injuries worth £4000, lost earnings of £2,000, medical treatment costs of £500 (the law allows for the recovery of private medical costs) and travel expenses of £50.  The total claim value would therefore be £6,550.

However, just because your solicitor believes your case is worth a particular amount it does not mean the Defendant’s insurance company will agree to pay that amount.  The Defendant’s insurance company might argue your injuries are only worth £3,000, your lost earnings £1,000, medical treatment £400 and travel £20.  The insurance company may therefore make an offer of only £4,420 instead of the £6,550 your solicitor believes your case to be worth.

This is one of the reasons it is very important to have a solicitor representing you.  Recently many insurance companies have begun pressuring injured people not to see a solicitor and to instead simply go through the insurance company as they make more money that way.  Whilst this might at first seem an easier and quicker option, we find the amounts offered by insurance companies tend to be far lower than what the case is truly worth, sometimes by many thousands of pounds; further, many insurance companies who deal with claims do not employ solicitors to work on the cases.  The danger with this is that you may be eligible for a particular type of compensation that only an experienced solicitor would be able to spot, or you might need to be seen by a specialist doctor to obtain an accurate outlook for the future.

A skilled and experienced personal injury solicitor will look carefully at your case to ensure you are properly compensated and, sometimes, will take the case to court if they feel the amount being offered is too low.

A recent example I came across is for a client who was at first going through the insurance company only, without her own solicitor.  Unfortunately, as the insurance company claim handlers were not qualified solicitors, part way through the case they admitted they did not know what to do next.  She came to Aston Knight Solicitors Bury for advice and now we hope to put her case right.  Sadly, there will be many people who end up receiving far less than their case is worth because they did not speak to a qualified solicitor first.

What makes things worse still is that whilst solicitors are very strictly regulated and must observe high standards of practice at all times, insurance companies are not regulated and so if they recover far less for you than your case is worth there is unlikely to be anything you can do about it or complain to.
